These Terms & Conditions ("Terms") are the service agreement between you ("client," "you") and Massage By Mike, a Florida-licensed massage therapy practice ("we," "us," "the therapist"). By checking the agreement box on your intake form, booking an appointment, or receiving a session, you confirm that you have read, understand, and agree to these Terms. If you do not agree, please do not book or begin a session. These Terms work together with our Policies & Disclaimers.

1. Who This Agreement Covers

These Terms apply to you as the client. If the client is under 18, a parent or legal guardian must review and accept these Terms and sign the intake form; if the client is under 16, a parent or guardian must remain present in the room for the entire session. By accepting on behalf of a minor, you confirm you are their parent or legal guardian.

2. Nature of Service & Scope of Practice

Massage therapy is provided for relaxation, stress reduction, and relief from ordinary muscular tension. Your therapist is a licensed massage therapist, not a physician, and does not diagnose illness, prescribe or adjust medication, treat disease, or perform spinal or skeletal adjustments. Nothing said or done during a session is medical advice or a substitute for care from a qualified healthcare provider. If you have a medical condition, you agree to consult your physician about whether massage is appropriate for you.

3. Informed Consent

You consent to receive massage therapy on the areas you approve on your intake form and in person, and you understand you may ask questions, adjust pressure or technique, decline any area, or end the session at any time, for any reason. Consent is ongoing — you may change or withdraw it at any point during the session, and the therapist will honor that immediately.

4. Assumption of Risk

You understand that massage involves sustained touch, pressure, and movement, and that even with skilled care it can occasionally cause temporary muscle soreness, minor bruising, or a skin reaction to oils, lotions, or creams. Deep-pressure work carries a higher chance of next-day soreness. You voluntarily accept these ordinary, foreseeable effects as inherent risks of massage. You agree to tell the therapist right away if you have known sensitivities or allergies so a different product or lighter pressure can be used.

5. Your Responsibilities

To keep your session safe, you agree to:

• Disclose honestly and completely — provide accurate, current information about your health conditions, injuries, surgeries, allergies, medications (including blood thinners), and pregnancy on your intake form, and update it if anything changes.
• Speak up in the moment — immediately tell the therapist about any pain, discomfort, pressure that is too much or too little, temperature, or anything that doesn't feel right. The therapist cannot know unless you say so.
• Confirm your draping preference and respect the professional boundaries below.
• Not attend impaired or while knowingly contagious (see §8).

You understand the therapist may decline or modify treatment for your safety, and is not liable for outcomes arising from conditions or information you did not disclose or disclosed inaccurately.

6. Draping & Florida Law

Under Florida law (Department of Health, Board of Massage Therapy — Fla. Admin. Code 64B7), the genitalia, groin, femoral triangle, anus, buttocks, gluteal cleft, and the breasts of female clients must remain draped (covered) at all times during a massage, unless you provide specific written informed consent to be undraped, which is then noted in your treatment plan. Your draping options are chosen and signed for on your intake form. You may change or withdraw your draping preference at any time, including during the session. Draping is never required to be removed.

7. Professional, Non-Sexual Environment

This is a strictly professional, therapeutic practice. There are no services of any sexual nature, ever. Any sexual remark, advance, or solicitation will result in immediate termination of the session, payment of the full session fee, refusal of all future service, and may be reported to law enforcement and the licensing board. This standard protects both the client and the therapist.

8. Right to Refuse or End Service

The therapist reserves the right to refuse to begin, or to discontinue, a session at any time — including for intoxication or impairment, inappropriate behavior, signs of a contagious or infectious condition, or any situation that feels unsafe. Where a session is ended for these reasons, the full session fee may apply. Please reschedule if you have a fever or a contagious or infectious condition.

9. Being Ready, Cancellations & No-Shows

Sessions are mobile — the therapist comes to you. Please have your space ready 10–15 minutes before your scheduled start time to review your intake and begin on time. If a session starts late because the space wasn't ready or you weren't available, that time generally cannot be added to the end of the appointment and the session is not discounted for the shortened duration.

You may cancel or reschedule free of charge up to 24 hours before your appointment through your confirmation email or your account. Cancellations within 24 hours and no-shows may be charged the full session fee — please call or text as early as you can so the schedule can be adjusted. Repeated late cancellations or no-shows may require a deposit for future bookings. (These booking terms mirror our Policies page.)

10. Your Location (Mobile/Outcall)

All sessions take place at your location. You agree to provide a safe, clean, private, and well-lit space with room for the massage table, and to ensure no one present creates an unsafe or inappropriate environment. The therapist may decline to begin, or may end the session and leave, if the location is unsafe or inappropriate, in which case the session fee may still apply.

11. Payment

Payment is due at the time of service unless otherwise arranged. Fees for sessions ended early due to a client's conduct, as described in §7 and §8, remain payable in full.

12. Privacy & Records

Your personal and health information is kept confidential and used only to provide and schedule your care. We do not sell or share your information. Your intake form and signatures are stored privately on the therapist's own computer, not with any third party, and are retained for at least one year as required by Florida law. By booking, you consent to receive appointment-related emails and texts (confirmations, reminders, and cancellation notices).

13. Limitation of Liability

To the fullest extent permitted by law, you agree that the therapist's liability is limited to the amount you paid for the session at issue, and that the therapist is not responsible for the ordinary effects of massage described in §4 or for outcomes arising from undisclosed or inaccurate information. Nothing in these Terms limits liability for gross negligence, willful misconduct, or anything that cannot be limited under Florida law. These Terms are not a waiver of the therapist's professional and legal duties of care.

14. Governing Law & Changes

These Terms are governed by the laws of the State of Florida. We may update these Terms from time to time; the version in effect on the date of your session applies. If any part of these Terms is found unenforceable, the remaining parts stay in effect.
